What’s a 60-day notice?
You’ve received a notice and aren’t sure what it’s about?
A 60-day notice is an official notice issued by your lender stating your failure to perform your payment obligations. Also known as a « 60-day foreclosure notice » or « Notice of exercise of the hypothecary right », the notice is part of the Civil Code of Québec. Once the notice is issued, it is registered in the Land Register of Québec and the 60-day deadline begins as soon as you have been served by a bailiff.
This means that you have 60 days to settle the matter by bringing the payments on your delinquent mortgage current. Failure to comply within the 60-day notice, your mortgage lender can ask the court for a “forced surrender” to seize the property in order to reimburse the amount owing.
